Section 84 Conditional Release Project
Section 84 of Canada's Corrections and Conditional Release Act gives voice to an Aboriginal community when an offender applies for reintegration to that community.
It starts a healing process between the community and the offender.
Every offender has the right to return to the community after serving their time. The Section 84 process will give the offender a “safety net” that assists them to live and be part of a community again, while holding them accountable.
MLSN is looking to take on a role with Section 84 releases because the opportunities exist but there is limited capacity for releases to happen in the current justice system.
The work MLSN is doing in our communities and in the justice system allows them to facilitate the process, form relationships and fill the gaps in the justice system.
Gladue Reports
Section 718.2 (e) of the Criminal Code provides that courts must consider other options for Aboriginal people other than imprisonment. The Supreme Court provided that a legal duty rests with presiding judges to consider the specific circumstances of Aboriginal people when considering sentencing options other than imprisonment.
To this end, MLSN has begun a process to enable Aboriginal People before the courts in Nova Scotia, to have access to "Gladue Reports" for their case.
